Baseball Star Wen-sheng Lu Granted a Deferred Prosecution Conditional on Completing Community Service; Schools in Kaohsiung Area Are Advised to Apply to the Kaohsiung District Prosecutors’ Office (“KDPO”) to Receive Free Baseball Coaching from Lu The KDPO recently resolved to defer the prosecution of Wen-sheng Lu contingent on his successfully performing 60 hours of community service. Lu has amassed an unsurpassed knowledge of baseball throughout his long career as a player with and then the general manager of the Uni-President Lions. After interviewing Lu, a KDPO probation officer decided that Lu may perform his community service by coaching baseball at Kaohsiung area schools as this mode of community service makes the most socially beneficial use of Lu’s baseball skills. Deferred prosecutions are designed to reduce the negative social effects associated with short-term incarceration. They are normally offered only in cases where a defendant commits a petty offense and only after considering other relevant factors such as the defendant’s prior criminal record and the extent to which public policy would be satisfied and general welfare be protected if a deferred prosecution is granted in a specific case. Where a deferred prosecution is offered to a defendant, a prosecutor can make it conditional on the defendant paying a fine to the State or a designated non-profit organization; making restitution to victims; performing some community service; or attending law-related seminars. It is hoped that through the wider use of the deferred prosecution scheme eligible defendants will not encounter the harmful effects of incarceration while ensuring that justice to the victim and the society as a whole is properly served, stated Wen-shang Cheng, a Chief Probation Officer of the KDPO.
