Pleading Guilty, Kaohsiung City Councilors Attended Lecture of Law Propagation for the Offence of Showing their Ballots. 39 Kaohsiung City Councilors revealed the result of their ballots for the Speaker and Deputy Speaker Election of Kaohsiung City Council on December 25th, 2010, in which the voting should be innominate and secret. Most councilors intentionally revealed the contents of their respective ballots to the voting supervisors and showed their ballots to indicate the specific candidates they voted for. The aforesaid Councilors violated Article 132 of the ROC Criminal Codes therefore. After being interrogated by prosecutors, most councilors had no argument towards images recorded by surveillance camera set in council hall and pleaded guilty of committing the crime against revealing confidentiality of voting. Taking the nature of offence, the potential harm to public order and the Councilors’ confession into consideration, Kaohsiung District Prosecutors Office (“KDPO” thereafter) decided to defer prosecution with the condition that required councilors to attend 40 hours mandatory lecture of law propagation or to pay a certain sum of money to non-profit organization. On 3th March 2012, Prosecutor Lo Shui-lang (羅水郎) addressed lectures titled ”City Governance and the Rule of Law” at KDPO to the aforementioned Councilors so that they will do their due diligence in supervising municipal affairs. Hopefully, a just of any election campaign is to be erected.
